1. Scope of Application:
1.1 For the business relationship between you and us, only the version of the following General Terms and Conditions current at the time of the order shall apply

2.2 You may select products from our online assortment in typical commercial quantities. Placement by us of products on the homepage is non-binding and does not constitute a proposal to enter into a contractual relationship. The products you select can be placed in a so-called shopping cart by clicking the "BUY" button. When you click the "Complete purchase" button, you are brought to the secure area, where you enter your personal information. By clicking the "Place order" button, you are making a binding request to purchase the items in the shopping cart. Before placing the order, you may view and change your personal information at any time.



2.3 After your online order is received, we will process it as soon as possible. We will send you an automatic acknowledgement of receipt by email, once again providing the details of your order. This results in a binding contractual arrangement. When several items are ordered at the same time, we must generally reject the order if one of the ordered items is not in stock.

2.4 Because our products are not mass-produced, there may be small differences from the pictures and details in the catalogue. We recommend that you check product details. All information and advice regarding our products is based exclusively on our past experience. Any values provided should be regarded as average values. All information about our products, especially the pictures, measurements and other indications are approximate, average values.

2.5 Although care is taken to ensure the accuracy of the information published on the website, it can contain inaccuracies, errors or incorrect prices, for which RMU SKIS UG accepts no liability.

2.6 Customer enquiries are answered promptly within at most two business days (e.g., by e-mail, telephone).

3. Prices
3.1 All prices are the final retail prices, i.e., they include all components of the final price, including the legally applicable value-added tax. Shipping costs are additional in accordance with the paragraph about shipping..

3.2 Our online shop may also offer discount codes, which can be used at the ckeck out of the buying process.

4. Cancellation instructions
You may cancel your contract in writing (e.g., letter, e-mail) without justification within 14 days or by returning the item, if it is sent to you before this deadline. The period begins upon receipt of these instructions in writing, but not before receipt of the goods by the recipient (in the case of recurring delivery of similar goods, not before receipt of the first partial delivery) and also not prior to compliance with our information obligations under article 246 (2) in conjunction with (1) 1 and 2 of the Introductory Act to the German Civil Code (EGBGB) and our obligations under 312 (1), sentence 1 of the German Civil Code in conjunction with article 246 (3) EGBGB. Timely dispatch of the cancellation or the goods is sufficient for compliance with the term of cancellation. The cancellation shall be addressed to:

4.1 Consequences of cancellation
In the event of effective cancellation, the services received by either party shall be returned and any benefits accrued (e.g., interest) shall be released. Should you be partially or wholly unable to return the services and use (e.g., compensation for benefits obtained) received from us or can only to do so in a deteriorated condition, you must provide compensation accordingly. You must only provide compensation for deterioration of the goods and for benefits derived if and when the benefits or deterioration is attributed to handling that goes beyond examination of their characteristics and mode of operation. "Examination of characteristics and mode of operation" shall be understood to mean the testing and trying out of the respective goods as is normally possible and common in the retail shop. Goods that can be shipped through normal parcel services are sent back at your own expense and risk.. Obligations to reimburse payments must be fulfilled within 30 days. This term shall begin for you when your cancellation notification is sent or upon our receipt of the returned goods.

4.2 Special Note: Your right to withdrawal expires early if the contract has been fulfilled by both parties in its entirety on your express request before you exercised your right of withdrawal

5. Delivery, delivery dates, transfer of risk, shipping and costs
5.1 The products are shipped exclusively to shipping addresses in the countries of the European

5.2 The shipping method, shipping route and the selection of the shipping company is at our discretion. 



5.3 RMU SKIS UG is entitled to perform partial services and to invoice them if no disadvantage results for the use of the products.



5.4 In the event that you are acting as an entrepreneur in terms of § 14 of the German Civil Code (BGB), the risk of accidental destruction is transferred to use when RMU SKIS UG has transferred the products to the shipping company, the freight carrier or for persons appointed to be in charge of shipping and even when partial shipments occur.



5.5 Delivery deadlines and dates are always non-binding. Delivery occurs contingent on timely and sufficient shipments to us. RMU SKIS UG strives to achieve on-time delivery. However, circumstances can occur (particularly outside of the sphere of influence by RMU SKIS UG) which make he impossible to maintain the delivery date/delivery deadline. Therefore the delivery deadlines only are estimates and RMU SKIS UG cannot guaranty a delivery date by the date indicated.

5.6 Shipping costs: Shipping costs for skis and other hardgoods will be 16€. This may change by buying more then one pair of skis due to additional handling and work. Softgoods like t-shirts, caps or sweaters will cost 6€. Deliveries to Switzerland and Norway do come with 0% german Tax and have higher shipping costs. Please ask for more details.

6. Payment
6.1 All of the information and prices listed are non-binding information which may contain errors.



6.2 You are authorized to make the payment by credit card, by pre-payment or paypal. RMU SKIS UG reserves the right to exclude certain forms of payment in individual cases. With payment by credit card or by pre-payment, this payment must be received before delivery of the products unless another agreement has been made between the Customer and RMU SKIS UG.

The Customer must assume the costs of bank fees incurred through transfers within the European Union outside of the European IBAN system.



7. Retention of property
7.1 RMU SKIS UG maintains ownership of delivered products until complete payment of all due invoices for the delivered products.



7.2 We are entitled to reclaim the product in the event of conduct by the buyer which violates the terms of the contract, particularly with delayed payments. When we reclaim the item, you are not permitted to withdraw from the contract unless we have expressly stated this in writing. We are authorized to use the item after its repossession, the revenue for usage is to be added to the liabilities of the buyer – minus reasonable usage costs.



7.3 In the event of attachments or other impairments by third parties, the buyer must notify us immediately in writing.

8. Data protection
8.1 All personal data required to fill the order are handled in accordance with the relevant regulations of the Federal data protection law (Bundesdatenschutzgesetze, BDSG) and the teleservice data protection law (Teledienstdatenschutzgesetz, TDDSG), saved in machine-readable form and kept confidential. Data required to process the order such as name and address can be passed by RMU SKIS UG to third parties as part of order handling, such as the shipment of the product, processing of payment transactions or the performance of a credit check.

8.2 Cookies

We wish to point out that our online shop uses cookies in order to identify you as a user and to offer you various services. Personal data are not saved in the cookies. With your usage of the online shop, you are indicating your agreement with the use of cookies.

8.3 We store your personal and order data as part of the setup of your personal customer account for the sole purpose of processing and handling your order and as part of your subscription to the Rocky Mountain Underground Europe Newsletter. As a matter of course, we commit to comprehensive protection of your personal data pursuant to the provisions of the German Federal Data Protection Act and the Telemedia Act. Furthermore, we guarantee that we will not give your address information to third parties. Your data are transmitted to us through digital security systems. Our websites incorporate technical mechanisms to protect against damage, destruction or unauthorized access.


9. Warranty, limitation of liability
9.1 If there is a defect in a purchase item which is our fault, the customer can request a re-filling of the order (remedy of defects or delivery of replacement parts). 



9.2 If we are not willing or not able to provide a remedy to the defect / replacement parts and, in particular, if the delay extends beyond reasonable periods of time for reasons beyond our control or if the efforts to remedy the defect/supply replacement parts fail more than twice, the buyer is entitled to choose whether he wishes to withdraw from the agreement or to request a reduction of the purchase price.



9.3 This warranty policy is valid as of September 1st 2015
Rocky Mountain Underground Europe provides this warranty to buyers who purchased the Rocky Mountain Underground product(s) over www.rockymountainunderground.eu. Rocky Mountain Underground products are guaranteed against all manufacturing or material defects (Defect) for the “Warranty Period” as defined below.

Rocky Mountain Underground products are compliant with their description and specifications; it is your responsibility to ensure that the products you purchase are compatible for the intended use.


This warranty is valid and enforceable only for products which had been purchased over www.rockymountainunderground.eu.

Please report us directly if items were purchased through our direct online sales store over warranty@rockymountainunderground.eu. If the items were purchased in a Rocky Mountain Underground authorized retailer store, please report first to your store.

Depending on the country, particular and variable warranties may apply in relation to applicable legislation. Nothing in this warranty policy can exclude or limit these statutory provisions.

9.4 Warranty Period:
The Warranty Period starts at the date of retail purchase of the Product by the original end-user purchaser. The product may consist of several different parts and different parts may be covered by different warranties periods (please report to “Warranty Period”).

9.5 Different Warranties Period is:

9.5.1: One (1) year for hard goods. From retail purchase date.
To the extent permitted by national laws, the Warranty Period will not be extended, renewed or otherwise affected due to subsequent resale, repair or replacement of the Product. However, during the Warranty Period will be warranted for the reminder of the original Warranty Period provided replacement or repair has been performed by Rocky Mountain Underground Europe or an authorized Rocky Mountain Underground retailer. Depending on the country, particular and variable Warranties Periods may apply in relation to applicable legislation. Nothing in this warranty policy can exclude or limit these statutory provisions.

9.5.2: The warranty does not cover: 

  • Damages due to transportation

  • Damages due to storage

  • Damages due to improper use of the products and poor maintenance

  • Damages due to rails, boxes, ledges, urban objects or any terrain park features

  • Damages due to non-observance of the instructions or restrictions for use of the products as defined in the products owner manual

  • Damages due to the products normal wear and tear 

  • Damages due to non-observance of the instructions for maintenance as defined in the products owner manual

  • Damages due to modification of the products

  • Damages due to any impact caused by sharp items, due to torsion, compression, a fall, an abnormal impact or other actions that cannot be under Rocky Mountain Underground Europe´s reasonable control.

  • Damages due to Second Party/non-original purchasers/users.
The present warranty is not enforceable if :
  • The Product is not returned in its original packaging, if it has been modified or repaired by any person or entity other than Rocky Mountain Underground Europe or an authorized Rocky Mountain Underground retailer.
  • The Product has been repaired with unauthorized spare parts. 

  • The Product serial number has been removed, deleted, altered or made illegible.
9.6: Warranty enforcement:
In case of Defect, Rocky Mountain Underground Europe agrees to accept the claim, replace or repair the Product at no charge for the end-user and return it. This shall be determined in the sole discretion of Rocky Mountain Underground Europe, or your local authorized retailer, unless this is impossible or disproportionate. The remedy will be deemed to be disproportionate by Rocky Mountain Underground Europe if it imposes costs on Rocky Mountain Underground Europe which, in comparison with the alternative remedy, are unreasonable, taking into account :
  • The value the goods would have if there were no Defect,

  • The significance of the Defect,

  • Whether the alternative remedy could be completed without significant inconvenience to the consumer.
Rocky Mountain Underground Europe agrees that all repair or replacement of the Product will occur within a reasonable period and without any major inconvenience for the consumer, taking account of the good’s kind and its fitness for purpose.
The consumer is not entitled to have the contract rescinded if the Defect is minor.

9.7 Limitation of Liability:
TO THE EXTENT PERMITTED BY NATIONAL LAWS, THE PRESENT WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES. ROCKY MOUNTAIN UNDERGROUND EUROPE SHALL NOT BE HELD LIABLE FOR ANY CONSEQUENTIAL DAMAGES INCLUDING BUT NOT LIMITED TO LOSS OF CHANCE OR PROFITS, LOSS OF SAVINGS OR REVENUE, LOSS OF DATA, PUNITIVE DAMAGES, LOSS OF USE OF THE PRODUCT OR ANY ASSOCIATED FACILITIES, COST OF CAPITAL, COST OF ANY SUBSTITUTE EQUIPMENT OR FACILITIES, DOWNTIME, THE CLAIMS OF ANY THIRD PARTIES, INCLUDING CUSTOMERS, AND INJURY TO PROPERTY, RESULTING FROM THE PURCHASE OR USE OF THE PRODUCT OR ARISING FROM BREACH OF THE WARRANTY, BREACH OF CONTRACT, NEGLIGENCE, STRICT TORT, OR ANY OTHER LEGAL OR EQUITABLE THEORY, EVEN IF ROCKY MOUNTAIN UNDERGROUND EUROPE KNEW OF THE LIKELIHOOD OF SUCH DAMAGES. ROCKY MOUNTAIN UNDERGROUND EUROPE SHALL NOT BE LIABLE FOR DELAY IN RENDERING SERVICE UNDER THE LIMITED WARRANTY, OR LOSS OF USE DURING THE PERIOD THAT THE PRODUCT IS BEING REPAIRED.

10. Place of performance and jurisdiction
The place of performance and sole jurisdiction is Munich insofar as it deals with a business person in the sense of the German Commercial Code (HGB) or a statutory corporation or if your place of residence or usual residency is at the time of the commencement of an action not in the country or is unknown.

11. Final provisions
11.1. If one of the clauses of these terms so be or become invalid, in full or in part, the remaining clauses remain unaffected.



11.2. All disputes resulting from this legal relationship are subject to German law with exclusion of United Nations Convention on Contracts for the International Sale of Goods.
